In March, the Supreme Court in Madrid ordered the Balearic government to pay 96 million euros to German property developer Matthias Kühn as compensation in respect of an historic reclassification of land in Puerto Soller - Muleta II - that prevented the building of luxury properties.

This money has been paid, but not to Kühn. It is currently being held by the Balearic High Court, which is overseeing the payment of debts by companies within the Kühn group.

The complexity of the group's structure - 25 companies and more than half of them having been declared bankrupt - makes it complicated to decide the future of these funds. The companies have cross-shareholdings, so the Commercial Court in Palma must decide how to deal with this distribution and the liquidation of different debts.

In addition to the bankruptcy proceedings, there is a criminal investigation. Another court is investigating the alleged concealment of assets as a means of avoiding the payment of a debt of more than thirteen million euros to the Tax Agency.

The Prosecutor's Office claims that there was a manoeuvre to keep the 96 million euros out of the reach of the tax authorities. The compensation formally corresponded to one of the companies, Birdie Son Vida, which was sold - with the permission of the bankruptcy administrator - to another company in 2021.

However, it was apparently not realised that the buyers were Kühn's two sons and that the son of Kühn's wife, Norma Duval, was administrator of this other company; she appears in the case as a possible profit-making participant in her husband's business.

The criminal proceedings are pending Tax Agency analysis of information obtained from Kühn's phone and computers following a search at his home in Palma in March. The Tax Agency is claiming a debt of over thirteen million euros, part of which relates to the liabilities of the bankruptcy proceedings. The 96 million euros would allow all debts to be settled.
